I am a longstanding member of the Aussie Whirlpool Broadband forums. It's basically my home online. The founder of those forums is being sued in what seems to be a landmark case about freedom of speech online in Australia. The company suing WP is a software company called 2Clix who took exception to a few negative posts regarding the quality of their software in the WP forums. The problem seems to be that when you Google 2Clix, the negative posts in the forums are on the first page and the company is suing for defamation and damages.

I'm reading the first few posts and I dont see anything waranting to be sued

In Belgium we have http://www.test-aankoop.be/ an organization who dedicates it's time at testing purchases and give their advice on it.  If that's possible I dont see why an opinion on a certain product on a public forum shouldn't...

I think they must know their software is shite and they don't like hearing about it..

As for suing them, any eejit knows that the sentiments conveyed on a public forum are the opinion of the individual concerned and not the boards facilitators... dry

The story has gone global. Even though they are being sued in Oz, it has implications for the net as a whole. 2Clix are going to wish they never started this litigation.  mad

Unfortunately it's considered published and as the admin/owner we have the responsibility of published content.

It's not as cut and dry as peoples personal opinions, off course the old IMO gets people out of that one, I think.

I watched a very similar case unfold on Teenage fanclub boards.
