Working as intended is not a "failure". Technically 3DMark 11 is available for pre-purchase - you get the key when you pay. It is not a "reservation" - or order that will be actually charged and shipped later - you immediately get what you pay for.
And all this talk is fairly silly and becomes moot the moment we get the benchmark executable out. I'm actually thrilled that people are so interested in the upcoming benchmark as to throw such a fit over this small delay - or would be, if some of them would be just a tad more mature about it
So by your logic as long as I purchase a key from Future Mark it doesn't matter where I source the actual code from ?
As it is the key that I have purchased ?
If that is not the case then Future Mark are the one's running the risk of releasing part of the product in this case the key prior to the other part of the product, the code.
That's their risk not the consumers.
I had this garbage spewed upon by Tesco lately, where I bought BC2, it wouldn't run.
I was told all this under software legislation garbo that as it was opened and the key registered I could not exchange or refund.
I didn't buy a key, I bought a game, the whole product in its entirety.
I wouldn't let it lie.

http://www.consumerdirect.gov.uk/Where by I was told without question on my first returned correspondence that all software falls under the sale of goods act and that I was entitled to a full refund.
On top of that software also falls under electrical consumer law, meaning that the purchaser has seven days statuary to return any product for refund, with any benefit of doubt placed firmly on the consumer and not the retailer/vendor.
So in a nutshell.
If a product is advertised in whole part for a release date, the release date arrives, only part of the product is received, this case the key, then the whole paid for product has not arrived and the vendor is in breach, not the consumer.
Everyone understands the risks of dishonesty and the need to fight piracy, but not at the expense of honest consumers who pre-purchase products in good faith, only to be treated like, frankly, crap even by official forum representatives of the involved company.
Vulgar, disgraceful and darn right offensive.
I know I'll never buy anything form Future Mark after reading this thread.
I can't believe how their official forum moderators speak to people, that is real bad for business.
